Artwork & Design Rights
Every design Herky Bird Co. produces is drawn from scratch. This page explains who owns that work and what you can do with it.
All artwork created by HerkyBirdCo remains the intellectual property of HerkyBirdCo unless a separate written transfer of rights is purchased. Artwork may not be reproduced, modified, or manufactured by another company without written permission.
What this covers
This applies to any design we create, including custom squadron tail flashes, unit patches, hold short signs, prop designs, and any proof or mock-up we send you — whether or not you go on to place an order.
What you can do
- Order the item from us, in any quantity, now or later.
- Share the proof internally with your unit or crew to get approval.
- Ask us for changes — revisions are part of the process.
What you can't do
- Send our artwork or proofs to another manufacturer to be produced.
- Reproduce, modify, or resell the design as your own.
- Use the artwork commercially without written permission from us.
Buying the rights
If you want to own a design outright — for example, a unit that wants to reuse its tail flash across other merchandise — that's something we can arrange. It's a separate written transfer of rights, priced case by case. Get in touch and we'll talk it through.
Unit insignia and official emblems
Official military insignia, squadron emblems, and unit patches belong to their respective services and units. Where a design incorporates an existing emblem, our rights extend to our original artwork, arrangement, and composition — not to the underlying insignia itself. We build these designs to honor the units that use them.
The $35 artwork fee
The artwork fee covers the time required to create your custom design. Paying it does not transfer ownership of the artwork. See the custom design request page for full fee terms.
